FLEX WARRANTIES

Chervon North America, Inc. ("Chervon") warrants to the original purchaser only in the United States (including its territories) and Canada, that the FLEX products identified below will be free from defects in material or workmanship for the durations from date of purchase or date of delivery (if later than the date of purchase) set forth below.

*The form is for product registration. Proof of purchase required to complete product registration. Failure to complete registration for your product does not diminish your warranty rights.

**The 1-Year limited warranty for FLEX STACK PACK™ Storage System covers only tool boxes and does not apply to system attachments and power tool accessories.

Other Accessories and Attachments: No Warranty

This warranty applies only to the original purchaser when purchased from an authorized FLEX retailer and may not be transferred unless otherwise prohibited by law (which may include the Province of Quebec). Please save your original dated receipt or complete the product registration form to ensure you have a record of when and where the product was purchased.

Because Chervon cannot control the quality of products sold by unauthorized sellers, Chervon reserves the right to reject warranty claims for products purchased from unauthorized sellers, including unauthorized internet sites, unless otherwise prohibited by law. CHERVON’S SOLE OBLIGATION AND YOUR EXCLUSIVE REMEDY under this warranty and, to the extent permitted by law, any warranty or condition implied by law, shall be the repair or replacement of parts, without charge, which are defective in material or workmanship and which have not been misused, carelessly handled, or damaged by repair by persons other than a FLEX Authorized Service Dealer. This warranty does not cover part failure due to normal wear and tear or negligence.

HOW TO OBTAIN SERVICE

Warranty service must be requested within the applicable warranty period. Please contact Chervon customer service toll-free at 1-833-FLEX-496 (1-833-353-9496) and be prepared to describe the alleged defect and provide the original dated sales receipt. Provided the warranty claim is preliminarily approved, please return the complete product to any FLEX Authorized Service Dealer. The purchaser is responsible for transportation of the product (including any attachments) at their expense to and from the Authorized FLEX Service Dealers.

ADDITIONAL LIMITATIONS & EXCLUSIONS

There are no warranties which extend beyond those stated herein. ALL IMPLIED WARRANTIES OR CONDITIONS APPLICABLE TO A PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, SHALL BE LIMITED IN DURATION TO THE DURATION OF THE EXPRESS WARRANTIES APPLICABLE TO SUCH PRODUCT, AS SET FORTH ABOVE. Any oral or written description of the products is for the sole purpose of identifying the products and shall not be construed as an express warranty. Some States and jurisdictions (which may include the Province of Quebec) do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

UNDER NO CIRCUMSTANCES SHALL CHERVON BE RESPONSIBLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES BASED UPON BREACH OF THIS LIMITED WARRANTY, BREACH OF CONTRACT, OR STRICT LIABILITY ARISING FROM USE OF THE PRODUCTS, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOST PROFITS, OR OTHER ECONOMIC INJURY. Some States and jurisdictions (which may include the Province of Quebec) do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Where any term of this warranty is prohibited by such laws, it shall be null and void, but the remainder of the warranty shall remain in effect. The disclaimers, exclusions, and limitations of liability under this warranty shall not apply to the extent prohibited by applicable law (which may include the Province of Quebec).

This limited warranty gives you specific legal rights, and you may also have other rights which vary from State to State and jurisdiction to jurisdiction.

This limited warranty applies only to products sold within the United States of America (and its territories) and Canada. For warranty coverage within other countries, contact your local FLEX dealer.

This warranty supersedes all warranty statements found in product manuals or other printed materials.
